Terms of Service

1. Acceptance of these terms

By accessing or using inhabitrealty.com (the “Site”) or any service offered by Inhabit Realty LLC (“Inhabit,” “we,” “us”), you agree to these Terms of Service. If you do not agree, do not use the Site.

2. Real estate brokerage relationship

Browsing the Site does not create a brokerage relationship between you and Inhabit. A brokerage relationship — buyer representation, seller representation, transaction-broker, or no-brokerage-relationship — is established only by a written agreement signed by both parties pursuant to Florida Statutes Chapter 475.

Inhabit complies with Florida Real Estate Commission (FREC) rules, the National Association of Realtors® Code of Ethics, and all applicable Florida statutes governing real estate brokerage practice.

3. Listing data and IDX

Listing information on the Site is sourced from Beaches MLS, Miami MLS, and other cooperating MLS feeds. Listings are deemed reliable but are not guaranteed accurate, complete, or current. Square footage, lot size, taxes, HOA dues, school zoning, and other property attributes should be independently verified by you prior to making any decision based on them.

Listings displayed on the Site that are marked as represented by other brokerages are published under the participating MLS’s IDX rules and remain the property of the listing brokerage and the MLS.

4. Permitted use of the Site

The Site is provided for personal, non-commercial use by individuals interested in real estate transactions. You may not:

• Scrape, harvest, or systematically copy listing data, agent information, or content;
• Use the Site or its contents to compete with Inhabit or with any cooperating MLS;
• Resell, redistribute, or sublicense listing information except as expressly permitted by the source MLS;
• Reverse-engineer, attack, or attempt to circumvent technical safeguards on the Site;
• Submit false information, impersonate another person, or use automated tools to submit forms.

5. Intellectual property

Site design, brand assets, written content, and original photography are © Inhabit Realty LLC unless otherwise marked. The open-source codebase that powers the Site is published separately under the GNU Affero General Public License v3 and is governed by that license, not these Terms.

6. SMS / text-message terms

By providing your mobile number to Inhabit (via a website form, in person, on a signed agreement, or by texting our brokerage line at +1 (561) 228-4888), you consent to receive text messages from Inhabit Realty LLC related to your real estate inquiry or transaction.

• Program: Inhabit Realty client communications (transactional and conversational).
• Message types: appointment + showing confirmations, offer + transaction updates, agent replies, and — only if you separately opt in — recurring market updates or saved-search alerts.
• Frequency: message frequency varies based on your transaction stage and any subscriptions you opt into.
• Cost: message and data rates may apply.
• Opt out: reply STOP at any time to stop receiving messages from us. We will send one confirmation that you’ve been unsubscribed.
• Help: reply HELP for assistance, or email hello@inhabitrealty.com.
• Carriers not liable: Wireless carriers (AT&T, T-Mobile, Verizon, and others) are not liable for delayed or undelivered messages.
• No third-party sharing: Mobile phone numbers and SMS opt-in consent are not shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

7. Third-party services

The Site integrates with third-party platforms including SkySlope, Beaches MLS, Miami MLS, RealSatisfied, Twilio (SMS delivery), and others. Each service has its own terms and privacy practices. Inhabit is not responsible for the availability or content of third-party services.

8. No warranty

The Site and all content are provided “as is” and “as available.” Inhabit disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Nothing on the Site constitutes legal, tax, or financial advice.

9. Limitation of liability

To the maximum extent permitted by Florida law, Inhabit’s aggregate liability arising out of or related to your use of the Site is limited to one hundred US dollars ($100). Inhabit is not liable for indirect, incidental, consequential, or punitive damages.

10. Governing law and venue

These Terms are governed by the laws of the State of Florida without regard to conflict-of-law principles. Exclusive venue for any dispute is the state and federal courts located in Palm Beach County, Florida.

11. Changes

We may update these Terms from time to time. The “Last updated” date above reflects the current version. Material changes will be communicated via the Site.
